For the notary qualification examination (hereinafter — the qualification examination), any legally capable citizen of the Republic of Armenia may apply who holds a bachelor of law qualification or the qualification of a certified law specialist, has no criminal record, and`
1. has completed an internship in notarial activity of at least 6 months, or:
2. has 3 years of professional work experience as a lawyer or an academic degree of candidate or doctor of legal sciences and has completed an internship in notarial activity of at least 3 months, or:
3. has not completed an internship in notarial activity but has at least 5 years of professional work experience as a lawyer or an academic degree of candidate or doctor of legal sciences:
Qualification Examination of Notaries
For the qualification examination, the applicant submits to the Ministry of Justice of the Republic of Armenia the following:
1. an application; 2. two colour photographs of 4 x 6 size;
3. a passport or other identity document and copies thereof (the original is returned after the person's identity is verified);
4. a copy of the certificate (diploma) of higher legal education;
5. in the case of having completed a notarial internship, the opinion of the notary supervising the internship, which must state the start and end dates of the internship, the actions carried out by the intern during the internship as provided for by the Law of the Republic of Armenia «On the Notariat», the fact of having completed training courses and the number of training-course hours, and a provision that the notary guarantees that the intern has fully completed the internship established by the Law «On the Notariat», as a result of which the intern fully commands the knowledge necessary to perform notarial acts and is ready to take the qualification examinations, and (or) a document certifying a lawyer's professional work experience, or a certificate of the academic degree of candidate or doctor of legal sciences;
6) the receipt of the state duty paid in the amount established by law for the qualification examination.
The state duty for the qualification examination of notary candidates is AMD 20,000 (twenty thousand), which must be paid to the following treasury account: 900005163622.
The qualification examination is conducted in Armenian and is open to the public. Representatives of the press and other mass media may be invited to observe the work of the qualification examination procedure.
The qualification examination is conducted in three stages: testing, the solving of practical problems, and an interview.
The tests are compiled by the Ministry of Justice of the Republic of Armenia. A sample of the tests is published, no later than ten days before the testing is held, on www.azdarar.am and the official websites of the Ministry of Justice of the Republic of Armenia. The testing may be conducted by means of a computer or in writing. Moreover, each applicant's test consists of 100 questions, for the solving of which the applicant is given two hours. During the testing stage, applicants are prohibited from bringing into the room and using printed or handwritten materials, technical devices, or means of telecommunication. The applicant is duly notified of the results of the testing stage no later than within one hour following the end of the testing stage.
At the stage of solving practical problems, in order to test the applicant's knowledge, he is given problems relating to notarial acts. When solving the problems, the applicant has the right to use handwritten and printed materials and computer equipment. The applicant is prohibited from using means of telecommunication. During the problem-solving stage, applicants are given ten problems to solve, each worth ten points. Four hours are given to solve the problems. The applicant is duly notified of the results of the practical problem-solving stage no later than within five days following the day of the end of the practical problem-solving stage.
The right to participate in the interview stage is acquired by applicants who have scored at least eighty-five points in the solving of practical problems. The interview with the applicants is conducted by the Minister of Justice of the Republic of Armenia. By decision of the Minister of Justice of the Republic of Armenia, other persons may also be present at the interview. Those applicants whose moral and psychological characteristics are sufficient to act on behalf of the State and to carry out notarial acts and services are deemed to have passed the interview stage. The applicant is duly notified of the results of the interview within five days following the day of the end of the interview stage.
The qualification examination results may be appealed by way of hierarchical procedure to the Minister of Justice of the Republic of Armenia or by judicial procedure within 10 days after receiving them.
Matters related to the qualification examination of notaries are governed by the Law of the Republic of Armenia «On Notariat» and by Decision N 789-N of the Government of the Republic of Armenia of June 6, 2002 «On Approving the Procedure for the Qualification Examination of Candidate Notaries», which was revised by Decision N 1463-N of the Government of the Republic of Armenia of September 29, 2011.
